Saving lives of some people depending on the deaths of others / the Grand Ayatollah Javadi Amoli’s Fatwa

SHAFAQNA – The Grand Ayatollah Javadi Amoli answered questions about saving lives of some people which depend on deaths of others.

Question: If saving lives of a large number of Muslims depend on deaths of others; for example for saving lives of 20 people who are in the third floor of a building, a part of the second floor must be demolished, and by doing so 5 people who are trapped in the first floor will be killed, what is the duty? And if this action causes the deaths of people, is this type of death incur Diyeh (Islamic compensation) or not, and if it incurs, who is liable?

The Grand Ayatollah Javadi Amoli: 1) Killing a Muslim to save more Muslim people is Haram. 2) Killing a Muslim whilst it is possible that he/she may remain alive; if it is carried out intentionally, or unintentionally, or through absolute mistake, each case has its own ruling.

Question: Is it allowed to abandon saving some of the injured, or the rescue mission for the sake of eliminating the killer contagious diseases in order to prevent the deaths of a large number of people of that area? And if it is permitted, does it incur Diyeh or not? And who is liable?

The Grand Ayatollah Javadi Amoli: If it is known or certain about transmission of the killer disease, abandoning the rescue of the injured is allowed, and the rescuing officer is not liable for Diyeh.
