The Grand Ayatollah Safi’s Fatwa about debtor’s imprisonment

SHAFAQNA – The Grand Ayatollah Safi answered a question about debtor’s imprisonment.

Question: Unfortunately hefty dowries have been spread in society which causes problems for families. In some of these families where the husband is not able to pay the dowry, the wife refers the case to courts which leads to husband being arrested. Is it allowed according to religious law for the husband who is not able to pay the dowry to be imprisoned?

The Grand Ayatollah Safi: Generally, if the debtor is not able to pay his debt, whether it is dowry or else, must be given time, and according to religious law, the imprisonment is not allowed.
