Can a suitor ask to marry a divorced woman who is observing her Iddah? The Grand Ayatollah Shobairi’s Fatwa

SHAFAQNA – The Grand Ayatollah Shobairi answered a question about asking to marry a divorced woman who is observing her Iddah (the period that a woman is required to observe after divorce before remarrying).

Question: What is the ruling on asking to marry a woman when she lives separately from her husband and they agreed to divorce and the process is being dealt with in the courts, or a woman who is observing Iddah after her divorce?

The Grand Ayatollah Shobairi: It is not allowed to ask to marry a woman, who has husband, and a woman who is in Iddah of revocable divorce, and a woman who is observing Iddah after the death of her husband. It is also not allowed to ask to marry a woman who is in Iddah of irrevocable divorce with the possibility that husband may return like when wife divorcing husband and wife pays husband for a divorce and it is possible that husband may return.
