SHAFAQNA – The Grand Ayatollah Sistani answered a question about custody of a healthy child by a mother who has AIDS.

Question: What is the ruling about the custody of a healthy child by a mother who has AIDS and the first breast feeding?

The Grand Ayatollah Sistani: The custody and guardianship of mother for her child cannot be taken away but it is necessary to take care that the illness is not spread, and if there is the rational possibility of the spread of the virus which makes the breast feeding directly from the mother dangerous for the child, it is necessary (breast feeding by the mother) to be avoided.
