Man faces ethnic intimidation, assault charges following anti-Muslim remarks

SHAFAQNA – Troy police say they have arrested a Farmington Hills man after reports of a fight at a 7-11 store on Crooks Road on May 1.Police say the suspect, 53-year-old James Duane Tree, entered the store to buy beer and passed ethnic slurs at the store clerk.“Among other remarks, Tree threatened to kill the clerk because he is a Muslim,” a statement by the police department said.When the store manager asked Tree to leave the store, he came around the counter and attacked the manager.

Tree punched the manager several times about the face with a closed fist while making additional offensive remarks about Muslims,” police said.The store manager, who suffered head and facial injuries, was treated on the scene by paramedics.Police say Tree fled the scene after the store employees overpowered and removed him from the store. He was arrested at a nearby gas station. Police say during the arrest, Tree made more derogatory remarks against Muslims.Tree was arraigned in front of Magistrate Judy Holtz on May 3 on two counts of Ethnic Intimidation and one count of Assault and Battery. He was given a $25,000 cash/surety or 10 percent bond.

Police say Tree was under the influence of alcohol at the time of the incident. A preliminary breath test administered to Tree after his arrest showed that he had a .16 blood alcohol level.
