What is my duty if I know my brother’s wealth is a mixture of Halal and Haram? The Grand Ayatollah Vahid’s answer

SHAFAQNA – The Grand Ayatollah Vahid Khorasani answered questions about wealth which is mixed with Haram.

Question: My father is ill and my brother pays for my family expenses. I know his wealth is mixed with Haram; what is the rule on me using his money? And by paying Khoms for what I receive from my brother, can I use that money?

The Grand Ayatollah Vahid Khorasani: If you are sure or certain that there is no Haram mixed with the money given to you, and there is only a possibility; there is no problem using it. And if you know the money given to you is mixed with Haram, and if Halal and Haram is not distinguishable, and its amount unknown, and not obvious the amount of Haram is less or more than Khoms, and the owner of the (Haram part of) wealth is also unknown; by separating one fifth of it, that wealth/money becomes Halal. And according to Wajib precaution, you must pay it (the one fifth) for the intention of removing responsibility of injustice and pay the Khoms. And according to Wajib precaution, this Khoms must be spent in cases of Khoms and Sadaqah for the intention of fulfilling a duty including Khoms and Sadaqah.
